Acceptance of Terms

Welcome to Ohefe. By accessing or using the Ohefe app discovery platform (the "Platform"), you agree to be bound by these Terms of Service (this "Agreement"). If you do not agree with any part of this Agreement, you must discontinue use of the Platform immediately. Ohefe reserves the right to modify these Terms from time to time. We will publish updates on the Platform, and your continued use after any changes constitutes your acceptance of the revised Terms.

Intellectual Property Rights

All content and materials on the Platform, including but not limited to text, images, graphics, logos, user interfaces, look and feel, and the underlying software and code (collectively, the “Ohefe Content”), are owned by Ohefe or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive license to access and use the Platform for personal and non-commercial purposes in accordance with this Agreement. No rights are granted to you to copy, reproduce, modify, distribute, republish, or create derivative works from the Ohefe Content except as expressly authorized by Ohefe in writing or as permitted by applicable law. Any user-submitted content remains your property, but you grant Ohefe a non-exclusive, worldwide license to use, display, reproduce, modify, and distribute such content as necessary to operate and improve the Platform and associated services.

Third-Party Links and Apps

The Platform provides discoverable listings and links to third-party applications that are hosted on Google Play. Ohefe does not host, manage, or control these third-party apps on this site; the actual application binaries and services reside with Google Play and the respective developers. By engaging with such third-party apps, you acknowledge that your relationship is with the third party, not with Ohefe. Your use of any linked app is governed by the terms and privacy policies of that third party, and Ohefe disclaims all responsibility for the content, quality, or performance of those apps. Ohefe does not warrant the availability, security, or suitability of any third-party app, and you agree to assume all risk arising from your interaction with them.

Disclaimer of Warranties and Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OHEFE MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY. OHEFE DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DOES IT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OHEFE, ITS AFFILIATES, AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PLATFORM OR ANY CONTENT THEREIN, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless Ohefe, its officers, directors, employees, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from: (i) your use of the Platform; (ii) your violation of these Terms; (iii) your violation of any third-party rights, including any intellectual property rights; or (iv) any information you submit, post, or transmit through the Platform.

Changes to These Terms

Ohefe reserves the right to modify this Agreement at any time. If we make material changes, we will provide notice through the Platform and/or by other reasonable means. Your continued use of the Platform after such notices constitutes acceptance of the updated Terms. If you do not agree to the revised terms, you must discontinue use of the Platform.

Governing Law and Dispute Resolution

This Agreement, and any disputes or claims arising out of or in connection with it, shall be governed by and construed in accordance with the laws of the jurisdiction in which Ohefe is incorporated, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located within that jurisdiction, except to the extent required by applicable law to resort to alternative dispute resolution mechanisms.
